Ensure vehicle modifications don’t cause noise pollution
 
         
 
 
 
     
 
 
 
What is noise pollution?

Noise pollution is included in the Protection of the Environment and Operations (POEO) Act and so it is a type of pollution that businesses need to be aware of. Generally speaking, a loud noise is considered to be “pollution” when it can be deemed as offensive. The offensiveness of a noise would depend on its volume, pitch, the time which it is occurring and the consistency of the noise. Regulatory Authorities (your Local Council or the Police) have the power to require offensive noise to cease and can issue notices to this effect.

How can vehicle modifications cause noise pollution?

If a vehicle is modified so that:

The exhaust noise level is above the legally specified maximum level (refer to the ADR 83/00 for information on specific vehicles)
Any noise control equipment is removed or rendered defective
Any noise control items are attached in a temporary manner (for example, baffles in the exhaust that are not welded or riveted in place)
Horns or car alarms exceed the maximum limits (120DB for a non-varying pitch and volume sound and 85DB for other types)
The engine or air intake system is louder than it was when originally manufactured

The increase in noise that the vehicle is making can be considered to be noise pollution.

Who is legally responsible for noise pollution from a modified vehicle?

Under Clause 19 in the POEO Regulations it is illegal to modify a vehicle in such a way that it breaches the noise pollution regulations. It is also the legal responsibility of the vehicle owner to ensure that the vehicle complies with the legislation.

 
 

Always ensure when asked to carry out any vehicle modifications, particularly when related to the engine or exhaust systems, that the vehicle does not breach the noise pollution regulations.
