| An MTA staff Member has provided evidence and assistance to Transport NSW (formally known as Ministry of Transport - MoT) which has culminated in a successful prosecution and conviction for touting, at Sydney Airport Domestic Terminal, by a Hire Car operator.
Briefly, the staff member had arrived at the Qantas Domestic Terminal from the North Coast. Whilst attempting to access the taxi rank, he was approached by a Hire Car Operator who induced him to use his services for transport to MTAs Head Office in Surry Hills.
This activity was reported to the MoT who, having secured a statement from the Association staff member, launched a prosecution against the errant Operator.
In February the matter was heard at Parramatta Court (the Operator pleading guilty to the charges) and a penalty was levied against him.
The Operator appealed the decision on a point of law (now pleading NOT guilty).
The appeal was heard on Thursday 27th 2010 of May (the Association staff member travelled to Sydney to provide evidence for the prosecution).
After both parties evidence was heard, the Judge noted that the appellants’ evidence was less than credible and dismissed the appeal with the original fine ($3,500.00) being applied and also awarding costs to the prosecution of approximately $9,000.00.
The pecuniary penalty exceeded $12,500.00 and should serve as a warning to any operator who wishes to conduct illegal activities by competing unfairly with legitimate Hire Car Operators.
